Terms of service
These draft terms apply when you use the Fairview Audit website or submit a request. Effective date: [CONFIRM: effective date]. By using the site, you agree to them. If you do not agree, please do not use the site.
Who may use the site
The site is for businesses and the people who act for them. You must be old enough to enter into a contract for your business, and you must have authority to submit a request on its behalf. Information you give must be accurate to the best of your knowledge.
Acceptable use
You agree not to:
- submit false or misleading information
- submit requests on behalf of a business without authority
- interfere with the site or try to gain access to parts of it that are not public
- copy or scrape the site in bulk without written permission
- use the site to send unwanted messages to firms or to Fairview
We may refuse or remove a request that breaks these terms.
What submitting a request does
When you submit a request, you agree that Fairview may share your details with the matched partner firm so the firm can contact you. On the not sure path, Fairview staff read your request first and then choose a match. The Privacy policy describes what we collect and how it is stored.
Submitting a request does not create an engagement with a firm. It does not oblige you to proceed, and it does not oblige a firm to accept you.
Your engagement with a firm
The engagement, and any fees, are between you and the partner firm under the firm's own terms. Fairview is not a party to that agreement. Read the firm's terms before you agree to them. Our article on questions to ask a partner firm lists topics to raise.
Fairview fees
[CONFIRM: whether Fairview charges any fee and, if so, to whom and how]. If Fairview charges nothing to businesses, this section will say so plainly.
Ownership of content
The text, design and structure of this site belong to Fairview or its licensors. You may read it and share links to it. You may not republish it without permission. Statements supplied by partner firms belong to those firms and appear with their written approval.
Links and third-party content
The site may link to other websites. Fairview does not control them and is not responsible for what they say or how they handle your data. A link does not mean Fairview endorses the site or its owner.
Availability of the site
We try to keep the site available, but we do not promise uninterrupted access. We may change, pause or remove parts of the site at any time without notice.
No professional advice
Fairview performs no audit, tax, accounting or legal work. Site content is general information. See the Disclaimer for the full statement.
Limits of liability
To the extent the law allows, Fairview is not liable for losses that arise from your use of the site, from a firm's work, or from a firm's failure to respond. Nothing in these terms limits liability that cannot be limited by law. [VERIFY: counsel to set the wording and cap on liability]
Governing law and venue
These terms are governed by the law of [CONFIRM: governing law]. Disputes will be heard in [CONFIRM: venue].
Changes to these terms
We may change these terms. The effective date will change when we do. Continued use of the site after a change means you accept the new terms.

Notes on this draft
FTC guidance says important disclosures should not be hidden in terms of use, and that clicking agree does not make a disclosure clear. For that reason, the roles of Fairview and the partner firm, and any compensation, are also stated in plain words on the Disclaimer page. The FTC also says businesses should keep the promises they make about personal data, so the privacy terms stay in the Privacy policy.
Note: This page is a draft pending counsel review. It is not legal advice.
